ACCEPTANCE OF TERMS
By accessing or using this site, its subdomains, or any of our forms, booking pages, or resources, including lead forms we run on Facebook and Instagram (together, the "Site"), you agree to these Terms and Conditions. If you do not agree, please do not use the Site.
WHO WE ARE
The Site is operated by Viceroy Marketing, doing business as Marketing Nerdy ("we," "us," or "our"). Better Fit EDU is a brand of that business. You can reach us at ian@betterfitedu.com or (801) 341-2263.
Better Fit EDU is a private company. We are not affiliated with, endorsed by, or acting on behalf of the Arizona Department of Education, any school tuition organization, or any other state agency or program.
OUR SERVICES
We help parents in Arizona understand what state education funding their family may qualify for, and help them find a school that is a better fit for their child. This includes a free Welcome Interview, a written summary of the programs your family may qualify for, and, where you ask for them, introductions to schools. Nothing on this Site is legal, financial, or educational advice, and it does not replace consultation with a licensed professional or with the Arizona Department of Education. Our services are free to families. We do not charge parents for the Welcome Interview, for the funding summary, or for an introduction to a school. Schools in our partner network pay us a fee when we introduce a family to them. That fee does not depend on whether your child enrolls, and you are never under any obligation to move your child anywhere.
THE WELCOME INTERVIEW
The Welcome Interview is a conversation, normally held over video, in which we ask about your child and then go through the funding programs your family may qualify for. You are not required to appear on camera. Booking one creates no obligation on either side, and nobody is required to move their child anywhere. Availability is limited and may change at any time. Please cancel or reschedule in advance using the link in your confirmation, or by calling us, so we can offer the time to another family.
ELIGIBILITY AND ACCURACY
Funding programs are run by the State of Arizona and by independent scholarship organizations, not by us. Their rules, deadlines, and award amounts are set by those bodies and can change. We tell you what we understand the programs to be and what we believe your family may qualify for based on what you have told us. We do not decide eligibility, we do not award funding, we do not handle or hold your funding, and we cannot guarantee that any program will accept your family or pay any particular amount. Applications to those programs are submitted by you.
YOUR RESPONSIBILITIES
You agree to provide accurate information about yourself and your child, to use the Site only for lawful purposes, and not to interfere with the Site or anyone else's use of it. You confirm that you are the parent or legal guardian of any child you tell us about, or that you are otherwise authorized to share that information.
INTELLECTUAL PROPERTY
All content on the Site is owned by Viceroy Marketing or its licensors and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from it without our prior written permission.
SMS AND MOBILE MESSAGING TERMS
Program name. We operate one text message program: Better Fit EDU Welcome Interview & Funding Updates. Program description. It sends confirmations and reminders for your Welcome Interview, messages from our team arranging a time with you, replies to your inquiries, and updates about the Arizona education funding programs you asked us about. How you join. You join by providing your mobile number and agreeing to the consent language, in one of two places: the opt-in form on our website, where the consent language appears directly beneath the submit button, or a lead form we run on Facebook or Instagram, where the same consent language appears with a checkbox you tick yourself. In either case you agree to receive text messages from Viceroy Marketing d/b/a Marketing Nerdy, operating as Better Fit EDU, at the number you provide. Consent is never pre-selected and providing it is optional. Message frequency. Message frequency varies. Cost. Message and data rates may apply. These are charged by your mobile carrier, not by us. Opting out. You can cancel the SMS service at any time. Reply STOP to any message. After you send STOP to us, we will send you one message to confirm that you have been unsubscribed, and you will not receive further messages. Getting help. If you are experiencing issues with the messaging program, reply HELP for more assistance, or contact us at ian@betterfitedu.com or (801) 341-2263. Consent is not required. Agreeing to receive text messages is not a condition of purchasing any product or service, and is not required to submit any form on the Site. Carriers. Mobile carriers are not liable for delayed or undelivered messages. Eligibility. By using this service, you represent and warrant that you are at least 18 years of age. If you are under 18 you may not use or access our services or opt into our messaging program. You must be the owner or authorized user of the mobile number you provide. Changes to your number. Please notify us if your mobile number changes so that messages are not sent to someone else. Privacy Policy. Your use of the messaging program is also governed by our Privacy Policy. THIRD PARTY LINKS AND SERVICES
The Site may link to or rely on third party websites and tools, including scheduling, hosting, analytics, and messaging providers. We are not responsible for the content, availability, or practices of third parties.
SCHOOLS
Schools we introduce you to are independent organizations. We are not responsible for their admissions decisions, their programs, their staff, or anything that happens after an introduction. Choosing a school is your decision.
DISCLAIMERS
The Site and its content are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
LIMITATION OF LIABILITY
To the fullest extent permitted by law, Viceroy Marketing and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or connected with your use of the Site.
INDEMNIFICATION
You agree to indemnify and hold harmless Viceroy Marketing from any claims, losses, or expenses arising from your misuse of the Site or your breach of these Terms.
CHANGES TO THESE TERMS
We may update these Terms from time to time. Changes take effect when posted on this page with a revised "Last updated" date.
GOVERNING LAW
These Terms are governed by the laws of Utah, without regard to conflict of law principles. Any dispute will be brought in the state or federal courts located in Utah County, Utah.
